Please Read Carefully Before Booking with House of Kyair

Welcome to House of Kyair. We are honored to bring elevated culinary artistry, intentional styling, and refined hospitality to your event. To ensure a seamless experience and maintain the highest standards of safety, professionalism, and transparency, the following terms, conditions, and disclaimers apply to all bookings, including but not limited to Cart Suites, Grazing Tables, Fruit Ascension Towers, Mini Boards, and any add-on services.

By booking with House of Kyair, submitting payment, or signing a contract, you acknowledge, understand, and agree to all terms outlined below.

FOOD SAFETY & ALLERGEN DISCLAIMER

House of Kyair prepares, styles, and displays food in environments that may come into contact with common allergens, including but not limited to dairy, nuts, soy, wheat, eggs, gluten, and other food sensitivities.

While we may attempt to accommodate allergy-related requests when communicated in advance, House of Kyair does not guarantee an allergen-free environment and cannot eliminate the risk of cross-contamination.

All clients and guests consume food at their own discretion and risk.

In accordance with Florida food safety regulations:

• Our displays are curated for peak freshness and are best enjoyed within two hours of presentation. Once displayed, food care and consumption timing fall outside the control of House of Kyair.

• Once the display is installed, House of Kyair cannot monitor temperature, handling, or guest interaction

House of Kyair is not liable for allergic reactions, medical conditions, illness, or injuries arising from food consumption.

LIABILITY WAIVER

House of Kyair is not responsible for:

• Allergic reactions or food-related illness

• Injury resulting from food consumption or guest behavior

• Spills, slips, or accidents caused by guests

• Damage caused by weather, terrain, or environmental conditions

The client assumes full responsibility for the chosen event environment and conditions.

House of Kyair reserves the right to refuse setup or discontinue service if conditions are deemed unsafe, unsanitary, or non-compliant with state or local requirements.
In such cases, no refunds will be issued.

PAYMENT & BOOKING POLICIES

• All deposits are non-refundable and applied toward the final balance

• Event dates are not secured until the deposit is received

• Final balances are due 7 days prior to the event date

• Bookings made within 7 days require full payment at the time of booking

• Failure to submit payment by the deadline may result in cancellation without refund

Add-on services are available only under the terms listed on our Services page.

PHOTOGRAPHY & CONTENT USAGE

House of Kyair may capture photographs or video of displays for marketing, branding, website use, social media, and promotional materials.

If you do not wish for your event to be photographed or shared, a written request must be submitted to
hello@houseofkyair.com at least 7 days prior to your event date.

If no written request is received, you grant House of Kyair full permission to use event imagery.

OUTDOOR EVENT DISCLAIMER

For outdoor events, clients must provide a weather-safe, shaded, protected, and stable setup location, including protection from:

• Rain

• Wind

• Direct sunlight or excessive heat

• Uneven or unstable ground

House of Kyair does not issue refunds for weather-related cancellations or limitations.

Once a display is set, House of Kyair is not responsible for changes in food quality due to environmental conditions.

EQUIPMENT & PROPERTY DISCLAIMER

All carts, décor, risers, props, serving pieces, and display elements remain the exclusive property of House of Kyair.

Clients are financially responsible for any lost, stolen, or damaged items during the event.

Carts with LED signage may require electrical access.
Most other carts do not require electricity unless otherwise stated.

CLIENT RESPONSIBILITY

Clients must provide:

• Safe, accessible entry for unloading

• Adequate space for carts and tables

• Stable surfaces for grazing displays

• Proper lighting for setup and service

• Parking or loading access near the venue

• Weather protection for outdoor events

Failure to provide suitable conditions may result in modified presentation or refusal of service without refund.

SERVICE DEFINITION & LIMITATIONS

House of Kyair does not provide:

• Cooking or reheating

• Extended food service beyond the booked window

• General event cleanup, guest bussing, or trash removal beyond the immediate service area

• Guest supervision

Services include setup, styling, and when booked, an on-site luxury attendant for the contracted service time only.

POST-SERVICE FOOD HANDLING

After the service window concludes, all remaining food becomes the sole responsibility of the client.

House of Kyair is not liable for:

• Food spoilage

• Temperature changes

• Contamination after guest interaction

• Improper storage or consumption

Per Florida guidelines, perishable food must be discarded after two (2) hours.

VENUE, PERMITS & THIRD-PARTY LIABILITY

Clients are responsible for ensuring:

• Outside vendors are permitted

• Required permits are obtained (if applicable)

• Venue rules and access details must be communicated no later than seven (7) days prior to the event date

• Last-minute changes may result in modified service, delays, or additional fees

House of Kyair is not responsible for:

• Venue-imposed restrictions

• Last-minute venue cancellations

• Delays caused by venue staff

• Damage caused by guests or third-party vendors

Any interference by third parties resulting in damage is the client’s responsibility.

INGREDIENT AVAILABILITY & STYLING SUBSTITUTIONS

House of Kyair reserves the right to make ingredient or styling substitutions due to:

• Seasonal availability

• Market shortages

• Safety requirements

• Venue limitations

All substitutions will maintain the quality, aesthetic, and brand standards of House of Kyair.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, House of Kyair’s total liability is limited to the amount paid for the booking.

House of Kyair is not liable for:

• Indirect, incidental, or consequential damages

• Emotional distress

• Loss of income or reputational harm

• Venue conditions or guest behavior

FORCE MAJEURE

House of Kyair is not liable for cancellations or delays caused by circumstances beyond reasonable control, including but not limited to:

• Natural disasters

• Severe weather

• Illness or emergencies

• Power outages

• Government restrictions

• Transportation disruptions

Deposits remain non-refundable. Rescheduling may be offered subject to availability.

INDEMNIFICATION AGREEMENT

By booking House of Kyair, the client agrees to indemnify, defend, and hold harmless House of Kyair, its owners, staff, and contractors from all claims, damages, losses, liabilities, or legal expenses arising from:

• Guest actions

• Food consumption beyond service windows

• Venue hazards or unsafe conditions

• Misuse or movement of equipment

• Children or unsupervised guests

• Third-party interference

This includes attorney fees, legal costs, and related expenses.

GOVERNING LAW & VENUE

This agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.
Any legal action arising from or related to this agreement shall be brought exclusively in the courts located within the State of Florida.

SEVERABILITY

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT

This Legal Disclaimer, together with House of Kyair’s Policies, Booking Terms, and Service Descriptions, constitutes the entire agreement between the client and House of Kyair and supersedes all prior discussions, representations, or agreements, whether written or verbal.

AGREEMENT TO TERMS

By booking any service, submitting payment, or signing a contract, the client confirms that they have read, understood, and agreed to all terms, conditions, and disclaimers listed above.
